Title: [1851] Died of a Broken Heart... after 25 Years' Compulsory Exile, Mr. Valentine Clark, A Victim to the Anomalous Constitution and Malpractice of the Ecclesiastical Courts.... Chancery and Ecclesiastical Courts. Chancery Reform Tracts Number 2. February 7th, 1851.
Description: Chancery Reform Association, London, 1851. First Edition, Disbound. Very Good Condition. 16 pages. A fascinating death notice, extending to around 34 lines in a display face, published as the final page of 'Chancery Reform Tracts Number 2' regarding the death of Valentine Clark alleging his fate was a result of suffering and treatment in the Ecclesiastical Courts, and published by the demand of his brother, Thomas, who was in his 25th year of imprisonment ordered by the Court of Chancery. For the full details of the case, see 'Reports of Cases Decided in the High Court of Chancery: With Notes' , Volume 4, p511-514. The case appears to have revolved around the Clark brothers rights to act as Trustees in an estate and whether they were withholding money from the beneficiaries of a will. Trivial enough in itself, but the anger and sense of injustice felt by the brothers is captured perfectly in the text. That whole movements had grown up around Chancery and Ecclesiastical Court reform illustrates the modernization of English law at the start of the Victorian era (Administration of Justice Act 1841 and subsequent legislation) and the residual effects that were left over from legal judgments prior to this period, and the challenges faced in making changes. Note; this is an original article separated from the volume, not a reprint or copy. Size: Octavo (standard book size). 16 pages. Quantity Available: 1. Category: Antiquarian & Rare; Featured; Inventory No: 234041.
